Representation measures are aimed at adults and minor children.
The opening of a representation measure is ordered by the court when an adult person is unable to take care of himself or manage his property and needs to be represented in the exercise of his civil rights. One or more persons are then appointed to represent it. When a relative can represent a person with an incapacity, this is a measure of private representation (for example, private guardianship, protection mandate). When it is impossible for a relative to represent the incapacitated person, the Public Curator may be appointed as part of a measure of public representation (for example, public guardianship).
In the context of the guardianship of a minor's assets, the guardian (s) have the responsibility to protect his assets, whether the role is assigned to the parents (legal guardians), to a supplementary guardian (person to whom a parent delegates or with whom he shares his parental responsibilities), or to a dative guardian (person other than the father or the mother). Property management supervision is mandatory for a legal or substitute guardian when the value of the assets exceeds $40,000, and regardless of the value of the assets for a dative guardian. The Public Curator assumes the responsibility of guardian of property for minor children who have no one to exercise this function in their environment.
